Intelligence Agencies Join FBI in Push Against Plans to Release FISA Abuse Memo

The FBI expressed “grave concerns about material omissions of fact that fundamentally impact the memo's accuracy”

Whistleblowers, Republican congressional members, and some former intelligence officials cite mounting concern that the White House may not release the House Intelligence Committee’s FISA abuse memo as the FBI pushed against plans to make it public based on false allegations that the memo contains information that would harm U.S. national security, sources tell this reporter.

The memo alleges severe abuse of the Foreign Intelligence Surveillance Act by employees of the FBI and Department of Justice but FBI Director Christopher Wray Wednesday warned against the release of the memo issuing a public statement from the FBI that the bureau has “grave concerns about material omissions of fact that fundamentally impact the memo’s accuracy.”

The four-page memo is currently under review by the White House National Security Council, as well as with the Director of National Intelligence, according to U.S. officials familiar with the review process. One U.S. official said they were concerned the review is being “slow-rolled in an effort to get President Trump to change his mind about releasing the memo.”

The FISA memo is expected to be released by Friday and the White House isn’t expected to object. On Tuesday, that affirmation was clear when President Trump was caught on his mic after his State of the Union address told a Republican lawmaker that “100 percent” the memo would be released to the public.

On Monday, the House Intelligence Committee voted along party lines to make the classified memo public and as long as the president doesn’t object after five days of review the memo can legally be released.

U.S. Intelligence agencies, however, are now joining the FBI and pushing back against the memo’s release, former intelligence officials told this reporter. Those intelligence officials are concerned that the memo will reveal details of how the Foreign Intelligence Surveillance Act is used in monitoring communications of foreign people overseas, said one former U.S. intelligence official.

Another U.S. official familiar with the memo and its contents disputed those concerns.

“There are no Intelligence Community equities involved in the memo and nothing in the memo or the attached documents violates any national security-related processes,” the U.S. official stated. “This memo does not deal with any international issues, only domestic issues.”

Republican congressional members who have already reviewed the memo say its public release is essential to accurately convey to the American people the extent of FISA abuse during the 2016 presidential election. Many members described the memo as “shocking” but Democrats, who suggest they have their own memo, pushed back on the FISA abuse memo initiated by House Intelligence Committee Chairman Devin Nunes, R-CA, and other ranking Republican members of the committee.

Rep. Ron DeSantis, a Florida Republican, and member of the House Oversight Committee, reviewed the FISA memo after it was made available to House members last week. He wants the memo to be made public and questioned the FBI and DOJs pushback.

“The FBI was afforded the opportunity to review the memo on Sunday and could not identify a single factual inaccuracy,” said DeSantis. “Accordingly, I find the Bureau’s statement to be a bit strange. Why not identify inaccuracies when you had the chance?”

Nunes issued a statement Wednesday in response to the FBI saying, “having stonewalled Congress’ demands for information for nearly a year, it’s no surprise to see the FBI and DOJ issue spurious objections to allowing the American people to see information related to surveillance abuses at these agencies.”

“The FBI is intimately familiar with ‘material omissions’ with respect to their presentations to both Congress and the courts, and they are welcome to make public, to the greatest extent possible, all the information they have on these abuses,” Nunes stated. “Regardless, it’s clear that top officials used unverified information in a court document to fuel a counter-intelligence investigation during an American political campaign. Once the truth gets out, we can begin taking steps to ensure our intelligence agencies and courts are never misused like this again.”

Another congressional official, familiar with the contents of the memo, said it was the FBI and DOJ, which refused to disclose or provide documentation requested by the House Intelligence Committee since early last summer. The congressional official said, “it was only when the committee warned of contempt of Congress did Department of Justice Deputy Attorney General Rod Rosenstein to turn over the necessary documents used in the committees’ review of the alleged FISA abuses by the FBI and DOJ.”

DOJ officials could not be immediately reached for comment.

“They are sparing no expense at trying to stop this memo from being released,” the congressional official said. “You have the Democrats, media and the deep state trying to stop the memo from going public and if they can’t they are preemptively trying to discredit it.”

The congressional official added that the memo was written so “there wouldn’t be any national security damage. First, they say that the memo’s release would be a national security concern and then the FBI says it’s the ‘omission of materials’ that doesn’t accurately explain what’s going on. But they didn’t want the committee to have any of the documents anyways. The committee had to fight tooth and nail for them. This is what it looks like when the deep state squeals.”

On Wednesday the FBI stated its objections the memo’s release, which has already been viewed in a secure area on Capitol Hill by more than 200 members of the House.

“The FBI takes seriously its obligations to the FISA Court and its compliance with procedures overseen by career professionals in the Department of Justice and the FBI,” said FBI officials in a statement. “We are committed to working with the appropriate oversight entities to ensure the continuing integrity of the FISA process.”

“With regard to the House Intelligence Committee’s memorandum, the FBI was provided a limited opportunity to review this memo the day before the committee voted to release it. As expressed during our initial review, we have grave concerns about material omissions of fact that fundamentally impact the memo’s accuracy,” the FBI stated.

  2. Sara does some great work,,, and if these agencies are worried about the memo ruining their reputation they need to realize that ship has sailed. Full disclosure and punishment of the guilty is the only path that will help them regain the trust of the people. How many times have we witnessed the truly guilty walk away scot-free because of party affiliation and the possibility that higher ups will be implicated? If these abusers of power are not deeply concerned about being caught then what’s to stop any of them in the future? They can redact anything alluding to ‘details of how the Foreign Intelligence Surveillance Act is used in monitoring communications of foreign people overseas’.

  8. Looks to me as if Wray has now got to go too. On Monday, he says there are ‘no factual inaccuracies’ in the Nunes committee memo. On Wednesday, the FBI says there are ‘material omissions’ in the memo. This Wednesday FBI statement isn’t attributed to any specific individual that I’ve seen, but it couldn’t have been issued without Wray’s approval.

    He can’t have it both ways. So he didn’t dare lie to Nunes, but now he’s allowed this statement diametrically opposite to his Monday statement. So he’s now trying to cover for the agency. Sorry fella, that doesn’t wash.

The concern for non publishing or serious redaction of The Memo may be Gowdy’s sudden shut down as if learning of the successful influence on Trump to back down, Gowdy said enough….I’m done and gone….hope not and may be tomorrow it will be out…but there does appear to be serious foot dragging underway….ugh….

  10. So far the only thing Obama’s been directly implicated in is exchanging emails, possibly containing classified info, with Hillary’s illegal server using a non-gov.com account and an alias.

    If classified info was transmitted or discussed in Obama’s emails to Hillary, or in Hillary’s to him, that’s a crime. Not being an attorney, I’m not sure if using a non-gov.com account, without sending classified info, is illegal or just unethical.

    So we need a few more dots to connect Obama to the whole thing. It’s certainly highly probable he was aware of it; perhaps he even initiated the plot. But we don’t know any of that for sure yet. My suspicion is that all in due time it will become clear he was in it up to his neck; but the investigations haven’t extended far enough yet to prove it.

    However, I read somewhere late last week that he had ‘lawyered up’. No specifics in whatever I read about who he’d hired or what issue(s) he felt he needed a lawyer for.
    Stay tuned. It took a full 2 years + months for Watergate to come to its final conclusion; and that’s when there was incontrovertible evidence given in the White House tapes.

    I’m sure Obama wasn’t stupid enough to have a taping system in his office. So finding documentary evidence of his complicity, or a John Dean-type administration whistleblower, is going to be difficult, and take time.

    IMHO, the first step in unraveling things further is to appoint a special prosecutor to investigate all this, well beyond the abuse of the FISA warrant question. And to do that, the DOJ’s got to fire Rosenstein and probably a bunch of other Deep Staters, and Congress has got to vote to appoint one and appropriate the money. So that will take time too. A lot of patience will be required, even though it sure looks as if a whole lotta folks all the way up to and including Obama are law-breakers of the highest order.

  15. To execute a warrant to be able to spy on a potential POTUS and Obama not sign off on it is beyond reasonable belief. Yes, there needs to be substantial proof before implicating Obama but really?
    My question is how the FISA warrant was written? And yes, what was the crime connected to the FISA warrant and was the evidence misrepresented to the Judge?

    These agencies are buying time until they can leak counter news to the NYT and Washington post before President Trump releases the memo…

    A lot of times President Trump is looking pretty good by midweek but on Friday the Washington Post or NYT drops news that will suck all the oxygen out of the air and lets the pundits on the left flood the weekend news and especially Sunday news shows with the bad news….haven’t you noticed this?

  19. Obama was aware of Susan Rice’s illegal unmasking of American citizens caught in NSA surveillance. His daily briefings would have contained information about FISA court actions initiated by DOJ in which unverified information was presented to the court as evidence of a crime. Testimony of turned witnesses will confirm he had access to and viewed illegally obtained Trump wiretapping results.

Flynn and Manafort should go right back to court and have charges thrown out and Flynn given a pardon.

  24. The deep staters may have a point in that the parts of the Steele dossier used to apply for the FISA warrant were verified, if THAT report was accurate. Some of the info about Trump or associates in the dossier were factual public knowledge IIRC.

    However, we have a text from Stroke & Poke that says they left explosive info out of their 302’s? IIRC; the investigative reportS that took down Flynn, & other critical matters like the FISA warrants. Clear evidence of covering up facts in communications with Congress.

    He’s both the FISA court judge that approved the Trump warrant IIRC, & the judge that found Mike Flynn guilty. 🙂 Busy little bee….

    I have seen no evidence of debunking, simply the “claim” of debunking, just like “pizzagate” was claimed to be debunked without anyone having asked, or answered, questions about the pictures, e-mails, logo’s, or questionable practices of a supposedly “kid friendly” pizza parlor, nor coded language used by Alefantis, the Podesta’s and many others.
    On these “debunked” “conspiracy theories” no questions have been asked or answered, so how can they possibly have been debunked?

  30. FBI and the other “intel” agencies must be autonomous. No one can be allowed to fire them, and congressional oversight is never appropriate. How can we have a proper police state, if the police are not all powerful? Just because the POTUS is head of the executive branch, does not mean he can have a say over the actual executive agencies.
    Un-elected bureaucrats must have that power. It’s in the constitution!

Hell Dems have already created their own version that will be released accusing GOP of tampering with the original memo.   38. Absolutely. As far as I’m concerned the FBI has no say in this. Past history indicates that they’d use the national security blanket to cover up their foul ups. No one was worried about national security as they jerked us around with a year+ investigation, replete with leaks from FBI and the special counsel’s team, that has produced nothing against President Trump. Release the memo, and release the supporting evidence.
